Part A
Terms of Service
These Terms form an agreement between you and the operator of the Najla Residence Owners Association System services identified in your account, order, invoice, or commercial disclosure (collectively, “Najla,” “we,” “us,” or the “Service”). They apply to the public website, account setup, dashboards, property records, assignments, marketplace, tickets, recurring work, votes, bills, and related services.
1. Eligibility and authority
You must have legal capacity to enter this agreement. If you act for an owner association, company, office, property owner, or another person, you confirm that you have authority to bind that account and provide the submitted information.
2. Accounts and roles
You must provide accurate information, protect your credentials, and use only your assigned role and property scope. Assignments, invitations, approvals, and account links do not transfer legal ownership and may require separate authority documents.
You are responsible for activity performed through your account unless you promptly notify Najla of suspected unauthorized access.
3. Property and operational records
You remain responsible for the accuracy and lawful use of property, unit, resident, provider, ticket, bill, vote, and work records you enter. Do not upload information you are not authorized to process or share.
Najla provides workflow and recordkeeping tools. It does not become a property owner, association, employer, broker, contractor, bank, or payment-service provider merely by operating the Service.
4. Providers and marketplace
Provider listings, ratings, placement tiers, and assignments help users discover and coordinate services. Unless expressly stated, Najla does not guarantee provider licensing, workmanship, availability, pricing, or fitness. Users must perform appropriate checks and providers remain responsible for their services and workers.
5. Acceptable use
You must not misuse the Service, impersonate another person, bypass access controls, scrape restricted data, introduce harmful code, interfere with availability, send unlawful content, or use the Service for fraud, harassment, money laundering, or any activity prohibited by Saudi law.
6. Availability and changes
We may maintain, improve, suspend, or limit functions to protect security, comply with law, or operate the Service. We do not promise uninterrupted operation. Material changes to these Terms will be presented with an updated version and effective date, and renewed acceptance may be required.
7. Suspension and termination
Najla may restrict or terminate access for material breach, security risk, unlawful activity, non-payment, false authority, or legal requirement. Where appropriate, we will provide notice and a reasonable opportunity to correct the issue. Mandatory rights and lawful record-retention duties survive termination.
8. Liability
To the maximum extent permitted by applicable law, Najla is not liable for indirect, incidental, or consequential loss caused by third-party conduct, inaccurate user data, provider performance, network failure, or unauthorized use outside Najla's reasonable control.
Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability arising from fraud, wilful misconduct, or any mandatory consumer right.
9. Governing law and disputes
These Terms are governed by the laws and regulations of the Kingdom of Saudi Arabia. The competent Saudi courts have jurisdiction unless a mandatory rule requires another forum. Please contact Najla first so we can attempt to resolve a concern promptly.
Payment terms
Payments and Moyasar
Payment information
Before a paid order, the Service should show the merchant, service, total price, taxes or charges, payment method, performance terms, and applicable cancellation or refund terms. You authorize only the amount displayed for the selected transaction.
Moyasar processing
Online payments may be processed by Moyasar or another disclosed licensed payment provider. The provider's terms and privacy practices also apply to its payment page and services. Najla is not a bank and does not itself provide regulated payment services.
Never place card numbers, security codes, banking passwords, or one-time payment codes in Najla tickets, messages, uploads, or support conversations. Publishable payment credentials may be used in the browser; secret credentials remain server-side.
Status, failure, and refunds
A transaction is complete only after the payment provider confirms it. A pending, failed, duplicated, reversed, or disputed payment may require provider and bank review. Refunds and cancellations follow the disclosed service terms, provider rules, and mandatory Saudi consumer law.
Review the official Moyasar terms for the payment-provider agreement that applies when Moyasar is used.
Consent record
Electronic acceptance
Checking the agreement box and submitting signup is your electronic acceptance.
You confirm that you had an opportunity to open, read, and retain these Terms and the Privacy Policy before submitting.
Evidence of assent
Najla may retain the accepted Terms version, Privacy Policy version, acceptance method, source page, and server timestamp with your account record. That record is intended to evidence your assent and have the same contractual effect as a signed acceptance to the extent permitted by Saudi electronic-transactions law.
Important distinction
This ordinary online acceptance is not described as a certified digital signature, and it does not waive any mandatory right or proof requirement under Saudi law. If a transaction legally requires a stronger signature, seal, authority document, notarization, or separate consent, Najla may require that additional step.
Part B
Privacy Policy
This Privacy Policy explains how Najla processes personal data in accordance with the Saudi Personal Data Protection Law (PDPL) and its implementing regulations. It applies when you visit, register, use a dashboard, submit a ticket, join a property scope, interact with providers, vote, or use billing and payment features.
1. Data we collect
Depending on your role and use, we may process identity and contact details, account and role records, property and unit relationships, operational tickets, work evidence, votes and eligibility, bills and payment status, device and security data, and communications with Najla.
We aim to collect only data that is adequate, relevant, and necessary for the stated purpose. Payment card data should be entered directly into the payment provider's secure interface and is not intended for Najla support channels.
2. Why we process data
We process data to create and secure accounts; verify roles and authority; operate property, assignment, ticket, work, vote, report, and billing workflows; provide support; prevent fraud; meet legal duties; maintain audit records; and improve reliable service operation.
Processing is based on the applicable lawful basis, which may include contract performance, legal obligation, legitimate interest recognized by law, protection of interests, or consent where consent is required.
3. Sources
Data may come from you, an authorized inviter or property representative, your organization, another user assigning a lawful scope, service providers, payment confirmations, or technical operation of the Service.
4. Sharing and processors
We may share the minimum necessary data with infrastructure, authentication, hosting, payment, communications, support, security, and professional-service providers under appropriate obligations. We may also disclose data where required by a competent authority or applicable law.
Role-based users see only the information necessary for their authorized property, unit, company, team, or task scope. A public marketplace card does not reveal private contact details unless a separately disclosed contact option is active.
5. International transfers
If data is processed outside Saudi Arabia, Najla will apply the requirements of the PDPL and the rules governing transfers of personal data outside the Kingdom, including required safeguards, assessments, and approvals.
6. Retention and deletion
We retain personal data only for the period needed for its purpose, legal obligations, disputes, security, and legitimate records. When retention is no longer required, data is deleted, anonymized, or archived under restricted access as permitted by law.
7. Security
Najla uses access controls, role and context boundaries, encryption in transit, protected server credentials, private storage where applicable, audit events, and operational monitoring. No system is risk-free, so users must also protect credentials and report suspected misuse promptly.
8. Cookies and device data
We may use essential session storage, cookies, and device information to authenticate users, preserve secure workflow state, prevent abuse, and keep the Service reliable. Non-essential analytics or marketing technologies should be disclosed and consented to where required.
9. Children
The Service is intended for adults and legally authorized organizations. A minor should not create an account or submit personal data unless a lawful guardian and applicable law permit it.
Data-subject controls
Your privacy rights
Subject to the PDPL and lawful exceptions, you may have the right to know how your data is processed, access it, obtain a copy in a clear format, request correction or completion, request destruction when no lawful retention ground remains, and withdraw consent where processing depends on consent.
Submit a request through Contact Us . We may need to verify your identity and authority before acting. If you believe your request was not handled properly, you may use the complaint channels made available by the Saudi Data & AI Authority (SDAIA).
